Terms of ServiceLast updated: October 6, 2026These Terms of Service ("Terms") form a binding agreement between NamikoASMR ("Creator," "I," "me") and any person who requests, commissions, purchases, or otherwise engages any service I offer ("Client," "you"). By submitting a commission request, commission details, or payment, Client confirms that they have read, understood, and agreed to be legally bound by these Terms. If you do not agree, do not proceed.1. ELIGIBILITY, AGE & LEGAL COMPLIANCE1.1 Client represents and warrants that they are at least eighteen (18) years of age, or the age of majority in their jurisdiction if that is higher, at the time of every request and purchase.1.2 Client represents that listening to, purchasing, and possessing adult content is legal where they live, and accepts sole responsibility for complying with their local laws.1.3 Creator may request age or identity verification at any time and may refuse or cancel any commission if verification is not provided.1.4 Creator is over eighteen (18) years of age. All content is performed solely by a consenting adult.2. NATURE OF CONTENT; FICTION DISCLAIMER2.1 All content is fictional audio entertainment intended for adults only. All characters portrayed or described are eighteen (18) years of age or older. Client listens at their own discretion and risk. Do not listen while driving, operating machinery, or doing anything that requires your full attention. Keep volume at a safe level.3. SERVICES OFFEREDCreator offers custom audio commissions ("Services"), either scripted (using a script provided by Client) or improvised. Creator does not offer video content of any kind.Immersive sound effects are included. Multiple voices or characters are available within reason for an additional fee (see Section 4). Performance style, pacing, tone, delivery, sound design, and creative interpretation are at Creator's sole discretion unless expressly agreed in writing beforehand.4. PRICING• Scripted: $8 per finished minute
• Improv: $10 per finished minute
• Minimum length: 5 minutes
• Each additional voice or character: +50% of the base price, per voice
• Privacy Fee: +75% of the base price (see Section 11)4.1 Final pricing is based on length, complexity, and applicable add-ons, and will be confirmed in writing before payment. All prices are in U.S. dollars.4.2 Quoted prices are valid for fourteen (14) days. Creator may change prices at any time; changes do not affect commissions already paid for.4.3 Creator may offer limited-time promotional pricing. Promotional rates apply only to commissions that meet the stated promotion requirements and are paid for within the promotion period, and cannot be combined or applied retroactively.5. PAYMENT5.1 Full payment is required upfront. Work begins only after payment is received and confirmed and the commission brief is finalized.5.2 Accepted payment methods are limited to:• Tips via OnlyFans
• Tips via Fansly
• ThronePayments made by any other method will not be accepted. Client is responsible for following the terms of the platform used to pay.5.3 Submitting payment constitutes acceptance of these Terms as they exist on the date of payment.6. REFUNDS, CANCELLATIONS & CHARGEBACKS6.1 All sales are final. Because each commission is custom digital content made specifically for Client, no refunds are issued once payment is submitted, including for change of mind, dissatisfaction with creative choices, or failure to use the content.6.2 Client cancellation: If Client cancels after payment, no refund is owed. Creator may, at her sole discretion, offer store credit toward a future commission.6.3 Creator cancellation: If Creator cancels a paid commission for reasons other than Client's breach of these Terms, Creator will refund the amount paid for any portion not delivered, which is Client's sole remedy. If Creator cancels because Client breached these Terms (including Section 8), no refund is owed.6.4 Chargebacks: Filing a chargeback or payment dispute instead of contacting Creator is a breach of these Terms. It immediately revokes Client's license to all commissioned content and may result in permanent refusal of service. Creator may provide these Terms, payment records, and communications to the payment platform to contest the dispute.7. TURNAROUND TIME, DELIVERY & ACCEPTANCE7.1 Standard turnaround time is fourteen (14) days from the later of (a) confirmed payment or (b) final confirmation of the commission brief, unless otherwise agreed in writing.7.2 Turnaround times are good-faith estimates, not guarantees. Delays caused by illness, emergencies, workload, technical failures, platform outages, or other circumstances beyond Creator's reasonable control are not a breach of these Terms. Creator will make reasonable efforts to notify Client of significant delays.7.3 Content is delivered digitally through the pickup page on Creator's website, using a private pickup code that gives Client access to listen to and download the content. Creator may instead deliver by private link or email where agreed. Client must keep their pickup code private. Client is responsible for downloading and saving delivered files. Creator is not obligated to store, back up, or re-deliver content after thirty (30) days from delivery.7.4 Content is considered accepted when it is delivered, unless Client submits a revision request within seven (7) days of delivery.8. CONTENT RESTRICTIONS (HARD LIMITS)The following content is strictly prohibited and will not be produced under any circumstances:• Any depiction, description, or implication of a person under 18, including age play or age regression
• Any real, identifiable person (including a real person's name, likeness, or private information) without that person's documented consent
• Any content that is illegal, or that violates the rules of the platform on which it is paid for, produced, or hosted
• Scat, vomit, race play, animal play, gore, or incest (adult step-relations such as step-sister or step-mother are acceptable)Any attempt to disguise, reframe, or circumvent these restrictions will result in immediate cancellation without refund and may result in permanent blacklisting. Creator decides, in her sole judgment, whether a request falls within a hard limit.9. REVISIONS9.1 One (1) revision round is included per commission, and must be requested within seven (7) days of delivery.9.2 Revisions are limited to minor adjustments (for example, correcting a name, a mispronunciation, or a small line change). Full rewrites, major concept changes, changes to the agreed brief, and full re-recordings are not revisions and may require an additional fee or a new commission.10. CLIENT-PROVIDED SCRIPTS & MATERIALS10.1 If Client requests a script written by a third party, Client must provide either (a) a direct link to the author's public script offer (for example, on Reddit) or (b) clear written proof that the author permits Creator to perform and, where applicable, publish the script. Commissions lacking proper authorization will be refused.10.2 Client represents and warrants that any script, idea, name, image, or other material Client provides ("Client Materials") does not infringe anyone's copyright, trademark, privacy, or publicity rights, and does not violate any law.10.3 Client grants Creator a worldwide, royalty-free, perpetual license to use Client Materials to produce, deliver, and, subject to Section 11, publish and promote the commissioned content.11. OWNERSHIP, LICENSE & PRIVACY11.1 Ownership: Creator owns all rights, title, and interest, including copyright, in every recording Creator produces, including performances, raw files, and edits. Copyright in a third-party script remains with its author. Payment purchases a license, not ownership.11.2 Client License: Upon full payment, Client receives a personal, non-exclusive, non-transferable, revocable license to listen to the content privately for personal, non-commercial use only. Without Creator's prior written permission, Client may not:• Repost, share publicly, or send the content to others
• Redistribute, resell, sublicense, or place it behind any paywall
• Upload it to any website, platform, or file-sharing service
• Edit, remix, splice, or alter it, or remove or obscure any watermark, credit, or identifying element
• Use the content, or Creator's voice, to train, prompt, or create any artificial intelligence, voice clone, synthetic voice, or similar technology11.3 Creator's Use: Unless Client purchases the Privacy Fee, Creator may publish, distribute, monetize, and use commissioned content for promotion on any platform, in any format, at any time, including with modifications. Creator will not publicly identify Client by name or username without Client's consent.11.4 Privacy Fee: If Client purchases the Privacy Fee, Creator will not publicly publish or sell the commissioned content. Creator keeps ownership and may retain copies for archival, record-keeping, legal, and dispute purposes. Creator may publish the content with Client's later written consent.12. WATERMARKS & IDENTIFICATIONCreator may embed audible or inaudible watermarks, identifiers, or tags in any content for copyright protection, leak tracing, and attribution. Removing, altering, or tampering with them is prohibited.13. CONFIDENTIALITY & RECORDS13.1 Creator treats Client's identity and commission details as confidential and will not disclose them except as needed to (a) process payment, (b) comply with law or a platform's requirements, (c) enforce these Terms, or (d) respond to a payment dispute.13.2 Creator may keep records of communications, briefs, payments, and age verification for business, tax, and legal purposes.14. CLIENT CONDUCTHarassing, threatening, abusive, or coercive behavior; pressuring Creator to exceed her limits; repeated boundary-testing; or requests for personal information will result in immediate termination of service without refund.15. DISCLAIMER OF WARRANTIESTO THE FULLEST EXTENT PERMITTED BY LAW, ALL SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CREATOR DOES NOT GUARANTEE THAT CONTENT WILL MEET CLIENT'S PERSONAL EXPECTATIONS OR PRODUCE ANY PARTICULAR EMOTIONAL OR PHYSICAL RESPONSE.16. LIMITATION OF LIABILITY16.1 TO THE FULLEST EXTENT PERMITTED BY LAW, CREATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATED TO THE SERVICES, THE CONTENT, OR THESE TERMS, EVEN IF ADVISED OF THEIR POSSIBILITY.16.2 CREATOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO A COMMISSION SHALL NOT EXCEED THE AMOUNT CLIENT ACTUALLY PAID FOR THAT COMMISSION.16.3 Creator is not responsible for the acts, outages, policies, fees, or data practices of any third-party platform, including OnlyFans, Fansly, Throne, or any file host.17. INDEMNIFICATIONClient agrees to defend, indemnify, and hold harmless Creator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) Client Materials; (b) Client's breach of these Terms or false statements, including about age or script permissions; (c) Client's unauthorized use, sharing, or alteration of content; or (d) Client's violation of any law or third-party right.18. ENFORCEMENTViolation of these Terms may result in any or all of the following, at Creator's discretion: immediate termination of current and future services without refund; revocation of Client's content license; DMCA or other takedown notices; reports to the relevant platforms; and legal action to recover damages, including statutory damages for copyright infringement where available, and reasonable attorneys' fees and costs.19. FORCE MAJEURECreator is not liable for failure or delay in performance caused by events beyond her reasonable control, including illness, family emergencies, natural disasters, severe weather, power or internet outages, equipment failure, platform suspensions, or changes in law.20. DISPUTE RESOLUTION & GOVERNING LAW20.1 Before filing any claim or payment dispute, Client agrees to contact Creator in writing and give Creator thirty (30) days to resolve the issue informally.20.2 These Terms are governed by applicable U.S. federal law and the laws of the state in which Creator resides, without regard to conflict-of-law rules. Any legal action must be brought individually, not as part of a class or representative action.21. GENERAL TERMS21.1 Entire Agreement: These Terms, together with any written commission confirmation, are the entire agreement between Client and Creator about the Services. If a written confirmation conflicts with these Terms, the written confirmation controls for that commission only.21.2 Written Communication: Direct messages on the platform used for the commission count as "writing" under these Terms.21.3 Severability: If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions stay in full effect.21.4 No Waiver: Creator's failure to enforce any provision is not a waiver of her right to enforce it later.21.5 Assignment: Client may not transfer any rights under these Terms. Creator may assign her rights at any time.21.6 Changes: Creator may update these Terms at any time. The version in effect on the date of payment governs that commission. Commissions paid for before the Last Updated date above remain governed by the terms in effect when they were paid for.22. ACCEPTANCESubmitting payment, commission details, or a service request constitutes full and binding acceptance of these Terms of Service.
